Membership Agreement
The Living Spa and Wellness, LLC [d/b/a THE LIVING]
Welcome to THE LIVING. Your membership is an intentional commitment to consistent care, nervous system regulation, and long-term vitality. Through regular treatment, we support your body’s natural rhythms — allowing both skin and body to restore, adapt, and thrive over time. Each visit is guided by what your system needs in that moment, honoring the connection between mind, body, skin, and spirit as one integrated whole.
As part of your membership, you are invited to enjoy your Grounding Foot Bath during your monthly visit. This experience may be enjoyed before or after your service and is not built into your scheduled appointment time. Please arrive 10–15 minutes early to enjoy this experience before your service.
During your birthday month, select any enhancement to your membership service when scheduling — you receive a complimentary 15-minute enhancement. It is our honor to celebrate you.
You will always be notified first of any events, seasonal offerings, and exclusive member opportunities. Black Friday is yours first. Small Business Saturday, we open to the public. But you will always know before anyone else.
Your Membership Agreement is not a contract — it is simply our mutual understanding of the care, commitment, and community you are joining. Please ensure all intake forms and policies are completed prior to your first visit. Arrive a few minutes early. Settle in. Let us take it from here. We are honored to care for you. — THE LIVING
By enrolling in a membership with The Living Spa and Wellness, LLC [d/b/a THE LIVING], you agree to the following terms and conditions.
Automatic Renewal Disclosure
Required by Georgia Online Automatic Renewal Transparency Act
By enrolling in a LIVING MEMBERSHIP, you understand and agree that:
- Your membership will AUTOMATICALLY RENEW each month on the 1st.
- Your card on file will be charged the monthly membership fee at each renewal.
- The renewal will continue INDEFINITELY until you cancel.
- There is NO MINIMUM COMMITMENT and you may cancel at any time with no penalty.
- To cancel, you may: (a) email hello@thelivingwellspa.com, (b) log into your account at thelivingwellspa.com/account and cancel directly, or (c) call 404-808-6519.
Membership Structure, Usage + Booking
Your LIVING MEMBERSHIP is an intentional commitment to consistent care and reserved time with our therapists. Each membership includes one [1] service credit per billing cycle, based on the selected membership tier.
Credits are issued on a recurring monthly basis and are intended for use toward the membership’s designated service type and duration. Members may book appointments in advance. If a member books services exceeding their available credits, standard service rates will apply unless otherwise specified.
Membership credits are:
- Non-transferable
- Non-refundable
- Intended for use within the billing cycle, subject to the Rollover Policy below
- Membership pricing does not exempt clients from attendance policies
Membership Benefits + Inclusions
Members receive exclusive member pricing on their monthly service, and 10% off services outside of their selected membership service — allowing you to explore body, skin, and nervous system care beyond your monthly visit. This courtesy does not apply to your included membership service or services already priced at a member rate.
Membership includes:
- Exclusive member-only pricing on your monthly service
- 10% off additional services outside your membership [excluding gift certificates and gratuities]
- 10% off retail products
- Grounding Foot Soak experience
- Complimentary birthday enhancement [15-minute]
- VIP access to events, seasonal offerings, and exclusive pre-public shopping — including 24-hour early access to Black Friday offers
Living Legacy Memberships
Members originally enrolled with MODERN Holistic Skin from 2019 to January 2026, prior to February 1, 2026, are designated as LIVING LEGACY members. As a LIVING LEGACY member, you retain your previous membership pricing and benefits as long as your membership remains active and uninterrupted.
If your LIVING LEGACY membership is canceled, paused beyond the permitted duration, or otherwise modified, re-enrollment will be subject to the current LIVING membership pricing and terms in effect at that time.
LIVING LEGACY pricing will remain in place through December 31, 2026. Beginning January 1, 2027, all LIVING LEGACY memberships will transition to the then-current standard LIVING membership pricing structure. You will be notified in advance of this transition.
Grounding Foot Bath Policy
As part of select membership experiences, members may enjoy a complimentary Grounding Foot Bath as an optional wellness enhancement, offered before or after their completed service.
- The grounding foot bath is not included in, nor counted toward, the practitioner’s hands-on service time.
- Practitioners do not have this offering built into the scheduled appointment reservation.
Members who wish to receive their Grounding Foot Bath prior to their scheduled service are encouraged to arrive 10–15 minutes early to allow adequate time without impacting the appointment start time. For massage-based services, members may also choose to enjoy the grounding foot bath after their experience, which is often preferred to support nervous system regulation and integration.
If a member arrives late, the grounding foot bath experience may be limited to post-service availability only and is offered based on lounge availability and operational flow.
Memberships are billed on a recurring basis and automatically renew on the 1st of each month, unless canceled in accordance with the cancellation policy. Membership pricing is subject to change for new enrollments; existing members retain their rate while their membership remains active, unless otherwise notified. Payment failure may result in suspension or cancellation of membership and benefits.
One [1] unused service credit from the immediately preceding billing cycle may roll over into the following billing cycle. Rolled-over credits must be used within that following cycle or they are forfeited. Credits do not accumulate beyond a maximum balance of two [2] at any time (one current month + one rolled over).
Rolled-over or unused membership service credits may not be redeemed for retail products, gift certificates, or monetary value.
Appointment Rescheduling + Cancellation
We reserve dedicated time for each client and practitioner. Your appointment time is reserved exclusively for you. When changes occur within 24 hours, the practitioner cannot refill that time, and the business absorbs the loss. These policies protect our practitioners, our schedule integrity, and the quality of care we provide. The following policies apply to all services, including memberships.
24-Hour Window Policy
Any change made within 24 hours of your scheduled appointment is considered a late change. This includes rescheduling, modifying, or canceling your appointment. Moving an appointment within 24 hours is treated the same as canceling it — rescheduling does not release the reserved time or avoid the policy.
Late Reschedule
- 50% of the service value will be charged to the credit card on file.
- Membership charge: this fee is in addition to your membership subscription payment.
- Rescheduling within 24 hours is considered a cancellation of the original time slot.
- This charge compensates the therapist for the reserved appointment time.
- If you reschedule within 24 hours and then cancel the new appointment, the 100% cancellation policy applies.
Late Cancellation
- 100% of the service value will be charged to the card on file.
- Membership charge: the monthly service is forfeited.
No Show
- 100% of the service value will be charged to the card on file.
- Membership charge: the monthly service is automatically forfeited.
Injectable Neurotoxin & Filler Safety Window
Membership benefits, credits, and pricing do not exempt clients from safety policies, injectable waiting periods, or cancellation and rescheduling fees. All members are subject to a four [4] week injectable neurotoxin [Botox®, Dysport®, Xeomin®, Daxxify®] and synthetic hyaluronic acid filler restricted window — the only exception being the LIVING NEUROTOXIN DISSOLVE + FLUSH™ service, intended to be performed within three [3] to seven [7] days post-injection, which uses external facial lymphatic drainage and gua sha only.
If a member books or arrives within the four [4]-week restricted window, service will be denied for safety reasons, and the appointment will be treated in accordance with cancellation policies:
- 100% of the service value will be charged to the card on file.
- Membership: the monthly service is forfeited.
Grace Allowance — Illness + Emergencies
We understand that acute illnesses and true emergencies can occur within the 24-hour window of a scheduled appointment. In these specific circumstances, members may request a one-time courtesy reschedule without forfeiture of their membership service credit or late-change fee, provided:
- THE LIVING is notified as soon as possible prior to the appointment.
- The request is made in good faith and not as a recurring pattern.
- The circumstance is a genuine illness, acute medical situation, or documented emergency occurring within 24 hours of the scheduled appointment.
This Grace Allowance is:
- Limited to one [1] occurrence per calendar year, regardless of membership tier, length of enrollment, or pause/freeze status.
- Extended at the sole discretion of THE LIVING management.
- Not guaranteed, and may be denied for any reason.
- Not applicable for no-shows, repeated late changes, or appointments within restricted medical safety windows.
- Not applicable to advance-notice situations (changes made outside the 24-Hour Window Policy follow standard rescheduling policy without penalty).
This allowance resets annually on January 1st and does not carry over. Repeated last-minute changes, even those framed as emergencies, will be subject to the full 24-Hour Window Policy without exception.
Membership benefits may include discounted service pricing, retail discounts, complimentary upgrades, VIP access to events, and special offers. Benefits are non-transferable and subject to change. Discounts are not valid on gift certificate purchases and/or practitioner gratuities. Membership discounts do not apply or extend to friends’ or family services.
Membership Pause / Freeze
Members may request to pause/freeze their membership for a minimum of one [1] and maximum of three [3] consecutive billing cycles per calendar year. While paused:
- No billing occurs.
- No new credits are earned.
- Existing banked credits remain on file but follow the standard rollover and expiration rules.
- Membership benefits [retail discount, member service pricing] are suspended.
To request a pause/freeze, members must notify THE LIVING in writing at least seven [7] days before their next billing date. Pauses/freezes initiated within seven days of the billing date will begin the following billing cycle.
Memberships may be cancelled at any time. There is no penalty or contract for canceling your membership itself.
Respectful Environment + Right to Modify or Refuse Service
THE LIVING Spa and Wellness, LLC [d/b/a THE LIVING] reserves the right to modify, postpone, or respectfully decline any service when contraindications, safety concerns, or policy conflicts are present — to uphold client safety, therapeutic integrity, and the highest standard of care. We maintain a professional, respectful, and safe environment. Inappropriate behavior will result in immediate termination of service.
Memberships are designed to support consistent care, long-term results, and a grounded relationship with your skin and body. By enrolling, you acknowledge that you have reviewed and agree to all membership terms, policies, and spa guidelines set forth by THE LIVING Spa and Wellness, LLC [d/b/a THE LIVING], including billing, cancellation, rescheduling, and attendance policies.
